Workcover breaches of the Listening Devices Act

Workcover recently took action against one of our members and attempted to interrogate two of our delegates in relation to a confidential discussion between them.

The Association acted immediately to advise Workcover that we considered their use of a recording of the confidential conversation on a mobile phone to be a breach of the Listening Devices Act.

Workcover refused to accept that any wrong doing occurred and have continued to defend their use of the recording, even though it was taken without knowledge of those involved.

The Association has sought legal advice and further clarification from counsel on this issue.

Consideration will be given to the next course of action and an appropriate recommendation made shortly.
