An application to vary the Waste Recycling and Processing Corporation (Salaries and Conditions of Employment) Award 2005 was lodged in the NSW IRC and the matter was listed for mention before Schmidt J on Thursday 30 March 2006.

Recently, the Award was varied to include provisions as handed down by the IRC in the Family Provisions Case and Secure Employment Test Case (with the exception of casual conversion provision, as there is no current ability for WSN Environmental Solutions to employ casuals).

This application was made to vary the Award to include salary increases of 4% from 1 July 2006 and 4% from 1 July 2007 and enhanced maternity, adoption, parental and extended leave provisions (to bring this Award in line with conditions in the Public Service (Conditions of Employment) Award).

The PSA had hoped to vary this Award by consent, however discussions regarding the 4% pay increases had not concluded prior to the introduction of the Workplace Relations Amendment (Workchoices) Act. Not knowing the full impact this legislation would have on WSN (a state owned corporation), it was necessary to make this application prior to Workchoices.

In the Commission, a representative for WSN stated that the corporation consented to increasing conditions of employment, but not salary increases. The matter has been relisted for May 1 2006.
